We reserve the right to amend these terms at any time. Any updates will take effect immediately upon being published on this page.
1. Legal Capacity & Strictly 18+ Only
Age Restriction: You must be 18 years or older to purchase any products from vapornow. Vaping products are strictly prohibited for minors.
Declaration of Age: By placing an order, registering an account, or interacting with vapornz.com, you legally declare and warrant that you are at least 18 years of age.
Legal Action: We reserve the right to take legal action and seek compensation from parents or legal guardians if an order is placed by a minor under false pretenses.
Health Warning: Vaping products may contain nicotine, which is a highly addictive substance.
2. Account Registration & Security
Information Accuracy: To create a membership account, you must provide accurate, current, and complete details (name, delivery address, phone number, and a valid email). Failure to do so may result in order cancellation.
Account Limit: Only one membership account is permitted per email address.
Credential Security: You are solely responsible for maintaining the confidentiality of your password and account activities. You must notify us immediately of any unauthorized use or security breaches.
Account Termination: We reserve the right to suspend or terminate accounts at our sole discretion, without prior notice, if we suspect any breach of these terms.
3. Product Availability & Order Acceptance
Invitation to Treat: All information, descriptions, and prices displayed on vapornz.com constitute an “invitation to treat,” not a legally binding offer to sell. A contract is only formed once we accept your order and dispatch the goods.
Pricing & IT Errors: We endeavor to ensure all pricing is accurate. In the event of a blatant IT or system error where a product is mispriced significantly below or above its market value, we are not obligated to honor that price. We reserve the right to cancel the order and issue a full refund.
Order Cancellation & Changes: All submitted orders are considered final. If you request a cancellation before dispatch due to a change of mind, we may, at our discretion, issue store credit instead of a cash refund. Change-of-mind cancellations are subject to a $40.00 NZD restocking fee.
Stock Discrepancies: While we keep inventory levels updated, stock availability is subject to change. If an item is out of stock, we will contact you promptly via email or phone to offer a full refund or an equivalent replacement.
4. Vaping Product Hygiene & Returns
Hygiene Policy: Due to strict health and safety regulations regarding vaping products, all E-liquid sales are final once opened.
Incorrect Orders: If we accidentally ship the wrong flavor or nicotine strength, you must keep the bottle fully sealed and notify our support team within 48 hours of delivery. If the bottle is opened or if 48 hours have passed, the product will be deemed accepted, and no exchanges will be processed.
Return Shipping Deductions: If a return is accepted for any reason other than a product defect, you will be liable for the initial shipping costs incurred by us, even if your order originally qualified for free shipping. This cost will be deducted from your final refund amount.
5. Pricing & Secure Payments
Currency & Taxes: All prices on vapornz.com are listed in New Zealand Dollars (NZD) and include Goods and Services Tax (GST). Delivery fees are calculated separately at checkout.
Secure Payment Gateway: Payments must be made via our integrated, fully encrypted secure payment gateway. We accept major credit/debit cards and approved secure local payment methods.
Fraud Protection: To the maximum extent permitted by law, vapornow is not liable for any damages or losses resulting from fraudulent or unauthorized credit card use on our system.
6. Limitation of Liability & Indemnity
General Disclaimer: To the fullest extent permitted by New Zealand law, vapornow and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of, or inability to use, this website.
Website Interruptions: We do not guarantee that our website will be completely free of interruptions, data transmission errors, or malicious code (such as viruses) introduced by third parties, though we take reasonable precautions to maintain security.
Indemnity: You agree to indemnify, defend, and hold harmless vapornow, its directors, employees, and agents from any claims, losses, or legal expenses arising out of your breach of these Terms and Conditions or your misuse of this website.
7. Consumer Protection & Governing Law
Consumer Guarantees Act (CGA): Nothing in these Terms and Conditions is intended to exclude or limit your legal rights under the New Zealand Consumer Guarantees Act 1993, except where products are purchased explicitly for business or commercial purposes, in which case the provisions of the CGA shall not apply.
Governing Law: This website, its contents, and all commercial contracts are governed strictly by the laws of New Zealand. You irrevocably submit to the non-exclusive jurisdiction of the courts of New Zealand to resolve any disputes.
International Customers: Our inventory and website policies comply with New Zealand regulations. If you access vapornz.com from outside New Zealand, you are solely responsible for ensuring compliance with your local customs and import laws. vapornow is not liable for packages seized or destroyed by international customs.
